Kafala of a minor child
Kafala under Moroccan law is a commitment to care for, raise and protect an abandoned minor, without creating any filiation or inheritance rights. The kafala request is submitted to the family court judge responsible for guardianship, and requires gathering several documents.
Required documents
- Written request in the name of the kafala applicant(s)
- Copy of the applicant's/applicants' national ID card
- Medical certificate of the applicant(s)
- Full copy or extract of the birth certificate of the child to be placed under kafala, and their medical certificate
- Copy of the applicants' marriage certificate
- Criminal record extract of the applicant(s)
- Income certificate and residence certificate of the applicants
- Abandonment ruling if the child is abandoned (father or parents unknown)
- Certificate of hardship regarding the child's parents, if known
- Approval from the applicant's country of residence to receive the child, in the case of international kafala
Translating the kafala file
When applicants reside abroad, they are usually required to translate all documents issued by foreign authorities (income certificate, residence certificate, criminal record...), as well as the kafala ruling itself once issued, in order to present it to the authorities of their country of residence.
