Exequatur of a foreign divorce ruling in Morocco
When a foreign court issues a divorce ruling between a Moroccan party and a foreign party (or between two Moroccans living abroad), that ruling is not automatically enforceable in Morocco. It must go through a procedure called "exequatur".
What is the purpose of this procedure?
Exequatur aims to have the foreign ruling officially recognized by Moroccan authorities (civil registry, passport services...), so the person can update their civil status in Morocco (update the marriage certificate, obtain an ID card showing "divorced" status, remarry, etc.).
Generally required documents
- Original foreign divorce ruling, in final form (not subject to appeal)
- Apostille or diplomatic legalization of the ruling, depending on the country of origin
- Sworn translation of the ruling into Arabic
- Copy of the original marriage certificate
Where is the request filed?
The exequatur request is filed with the competent court of first instance — either where the marriage took place or where one of the parties resides in Morocco. Our agency in Tangier assists you with the sworn translation of the ruling and the other required documents, recognized by Moroccan courts.
